Step by Step Guide on How to Write your Will:
Completion Time - 2 Hours
You will need 2-3 sheets of A4 size paper and a black pen ready.
Step 1. First, Start by Writing Last Will and Testament of "Your Full Name" at the top of the document.
Step 2. Revocation and Preliminary Declarations. On a new line below put "Revocation & Preliminary Declarations" underline this and underneath on a new line state "I Revoke all my former Wills and Codicils".
Step 3. Next on another line below write "I, Your Full Name" currently reside at "Your Full Address including postcode".
Step 4. Next leave a space and below State your Marital Status and whether or not you have any children and how many if you do. (For Example:)
I am married and have children" or "I am single and have no children"
Step 5. Appoint an Executor. On a new line put "Executor" and underline it. An Executor is a person you entrust with carrying out the instructions of your will. State Executors full Address including postcode. For Example:
"I appoint John Smith of 1 Oxford Street, Westminster, London, W1D 1BS to be the executor of this my Will."
So far after Steps 1 to 5, your Will should look something like this:
Step 6. Appoint a Legal Guardian (Someone whom you want to leave your minor child(ren) with if you have any) and state your Legal Guardians full Address including postcode. For Example:
"I appoint Jane Smith of 1 Oxford Street, Westminster, London, W1D 1BS to be the Legal Guardian of my Children should they be under the age of 18 at the time of my death."
Step 7. Specific Gifts: This is the act of giving away an asset you own, including money, property or a specific item. (when gifting an item or property such as a car, always be very descriptive and include specific details of the car, such as the colour and the Registration plate number) For Example:
"I leave the sum of £5000.00 to John Smith of 1 Oxford Street, Westminster, London, W1D 1BS."
"I leave my Silver Range Rover Sport HSE (Reg: AB61 QWE) to John Smith of 1 Oxford Street, Westminster, London, W1D 1BS.
Step 8. Appoint a Pet Caretaker. This is someone whom you choose to take care of your pet(s) if you have any in the event of your death. State your Pet Caretakers full Address including postcode, followed by the name and a short description of your pet. For Example:
"I appoint Jane Smith of 1 Oxford Street, Westminster, London, W1D 1BS to be my pet new caretaker of "My Female, Long Furred, German Shepard Breed Dog named Sammy" in the event of my death"
Step 9. Estate Residue Distribution. Distributing the residue of your Estate means to give the remainder of your assets to a person or multiple people, if you choose to give it to 1 person, then that person will receive 100% of your remaining assets. (including property and money) If you choose to distribute your estate to more than one person, the each person will receive an equal share of the remainder of your estate. (Make sure to Include the persons or peoples full Names and Address's including postcodes). For Example:
"I give the remainder of my estate to John Smith of 1 Oxford Street, Westminster, London, W1D 1BS"
OR if distributing equally between more than one person:
"I distribute the remainder of my estate equally between:
From steps 6 to 9, you should have something like this:
Step 10. Attestation/Signature. State that you declare the document to be your Last Will and Testament, the city and country you are signing in, leave a space for the date of signing, that you are of legal age, under no constraint or undue influence and that you are about to sign your new Will freely and voluntarily. DO NOT SIGN OR DATE YET, only create date and signature panels ready for signing. For Example:
"I, John Smith the within named testator, set my hand in the city of London, England in the United Kingdom on this date 01/01/2001 and declare that this instrument is my Last Will and Testament, that I am of legal age in this jurisdiction to make a Will, that I am under no constraint or undue influence and that I sign this Will freely and voluntarily."
Step 11. Witnesses. You must now make a witness section for TWO witnesses with Blank fields for their Name, Address, Occupation & Signature. For Example:
From steps 10 to 11, the last part of your finished Last Will & Testament, ready for reading and signing should look something like this:
Step 12. Finally, You must read out your Will in front of your Witnesses, you can sign and date when you get to those parts when reading through your Will. When you've finished reading and signing your Will , your Witnesses must write their full Name, Full Address including postcode and Occupation, and finally your witnesses can sign to confirm that you have read out your Will to them under no constraint or undue influence, freely and voluntarily.
Congratulations, That's it! You have written your own Will.
